The case of Aaron Swartz is the second instance of a suicide where Heymann was the prosecutor. Previously, Heymann was the prosecutor in the case against American hacker Jonathan James.[5] In his suicide note, James claimed to be innocent. [5]

Jonathan James was also just a minor, 15 years of age when Heymann got on his case. He commited suicide at 16.
"I have no faith in the 'justice' system. Perhaps my actions today, and this letter, will send a stronger message to the public. Either way, I have lost control over this situation, and this is my only way to regain control."

This is a terrible tragedy. I am a biological scientist. My research is funded by the federal government (NIH). I am compelled to publish the results of my research (publish or perish) in a number of academic journals. These journals charge money (from my NIH grants) to pay for the right to publish in their journals. They then charge subscription fees to others to access the published articles. I do not receive any money for this. The federal government is not reimbursed for this. I want my research disseminated to a wide audience, but must relinquish all control as soon as I publish in one of these for-profit journals. I searched the JSTOR site and found a number of my articles listed there. It is OUTRAGEOUS that the government even contemplated prosecuting Aaron Swartz for 'stealing' information that the public had PAID FOR not once but twice (once to support the research and again to publish the results of the research). It is because of this outrageous practice that many scientists have started publishing their research in online, non-profit, open access journals such as PLOS.

MIT professors, who are so full of themselves, are the only ones who might take seriously such a fool’s errand as a worthy objective for the brilliant and rebellious Swartz or the law suit as the cause of his so-called “suicidal depression.”

The mass media have been fed, and eagerly swallowed, the unpalatable lies hurled against a courageous young man whose guilt lies solely in his disgust at the online filth from “respectable” Internet paragons who have deviously corrupted the morals of his generation. America’s leading center for computer science has unleashed a campaign of slander against Swartz, who cannot defend himself through the media or in the docket now that he is dead.

My personal regret is that he had to act alone without the guidance and support of those faraway people including myself who have been fighting against the same vile pedophile elite. In American society where tens of thousands of children disappear every year without any serious investigation or public concern, the young man assumed the burden of justice on his own and paid the ultimate price for it. Using the JSTOR issue as a mere cover for his covert investigation into MIT wrongdoing was an immature tactic, which now undercuts his reputation postmortem.
