Have you notified them of the reason you didn't attend?

My husband got stopped for driving at 120 mph a bit back, and they can take take your licence away for that even if you've an otherwise clean record. They didn't do though, because they took into account the fact that he was travelling between the NW & NE regularly visiting his dying mum.

Just turn up on the 20th coates with supporting evidence as to why you couldn't appear on the 23rd December.
Problem is there is due process you can follow to inform the court why you wouldn't have been able to appear on the 23rd. I am assuming you didn't do that?
Please, for the sake of your dad, don't do what you are suggesting. You might get your 5 minutes in the press, but you'll be left without a licence and how is that going to help your dad or yourself in the long run if you need to take him places?
It's not because the magistrates are "masonic scumbags" (I don't deny some magistrates are power crazy and see themselves as jumped up judges), it is the due process set in law that they have to follow.
I appreciate you are stressed out at the moment and totally focused on your dads recovery, but please don't add to your long term stress by adding this to your long term ability to help your dad.
Just kick it into touch and win this by keeping your license for you and your dads sake.

Your hubby was very, very lucky Gilly because 30+mph over any speed limit is an automatic ban.

Even in a so called automatic ban situation, they do give you an opportunity to present a case for yourself.

You can also contact the police and ask if you can be put through a speed awareness course.
It costs a few bob but you won't get any points .
Basically non contact will be viewed as your fault by the press too so they won't be interested, even the local paper would just shrug and say so what.
35 mph is the minimum speed in a 30 zone according to the police guidelines for a conviction, if you contact them and explain your absence and say you're willing to do the speed awareness course they might just let you off with it. You'll need to contact them ASAP though.

i pleaded not guilty earlier saying that i wasnt happy with the speed camera and asked them if it had been calibrated on the day i was supposed to have been speeding...i doubt they can provide proof of this so in my eyes its case dismissed

Well it's not your decision to make, so you'll lose with that attitude.

OK, so you originally put in a plea on the grounds of them providing proof of the camera having being calibrated, and now you want to plea on the grounds of your dad's health?
Hmmmm...think you might have told us about your original plea there coates. Think you've burnt your bridges with the courts.
Sorry.

Sorry coates, but there is a reason why there is a 30mph speed limit in built up areas....there is a chance of survival for somebody IF YOU DO HIT A PEDESTRIAN, how does that fit in with your common law?
As to saturn worhipping whores....that's where you lose my respect.
Best of luck keeping your licence.

Just for your own benefit really.
We all know what you did is really irrelevant but they just don't give a shit basically, so you're screwed.
Its basically why the whole 'freeman on the land' movement was such a farce on DIF etc, I don't know how people can expect decent lawful consideration from a corrupt cronyist establishment, they'll just carry on what they're doing regardless.
Personally I don't respect them at all, I just pretend to and make the best of it. I'd recommend you do the same, if you're quick enough like I said you might get them to accept a speed awareness course and then you won't suffer points or losing your license or court appearances or expensive insurance later on and if I were you I'd think carefully about it. Don't get pissed, keep your cool and get the best situation you can out of it.

i know what ya saying but i think my licence is clean so how can they threaten to disqualify me from driving on a 5mph over speeding offence unless its because i didnt send in my driving licence which in there eyes is another points offence or maybe it isnt? As for being a built up area it was an A road the A435 between redditch and Evesham on a early sunday morning so hardly anyone about..

You might not lose your license but at the very least its 3 points for sure no matter what you do and far worse you're looking at double the insurance when renewal comes and the insurance company will know automatically about it :/

Unfortunately jaywalkers, pissed up pedestrians...and lets add doddery old folk, wild little kids, people yapping on their mobiles et all to the list shall we...unfortunately forget where the pavement ends and where the road starts. And while we're at it...let's add the idiotic drivers who disregard the speed limit and go tearing round the corner only to slam into a pedestrian who only seconds before had the guile and gumption to check the road was clear but some half brained dim wit comes tearing around the corner thinking he owns the road and is driving at Brands Hatch!

I have been driving for a hell of a long time..had jobs where I HAD to have a license, and one job for several years working for a car company driving on average 70,000+ miles a year. Done all sorts, including off road and race track and rally driving courses...and guess what...yeah...even done a speed awareness course to avoid getting points on my licence :D
Many years ago I was driving around with 12 points and what they then called 3 in brackets on my licence because the cops on Anglesey decided to do me for a dual offence. I guess they didn't like seeing a young 20 something woman driving around in a brand new LWB Shogun. The point being, my licence was my work. I had to appear in front of magistrates because I appealed. I went armed with enough evidence to throw doubt on what the police claimed, a letter from one of the directors at Mitsubishi, and my mum came with me. I think the fact I spoke welsh and the copper didn't also swayed the welsh speaking magistrate. :winky:
What I and Andy are trying to say is...if you need your driving licence, you do everything you can to keep it. It's no bloody fun trying to pass your test these days and you wont get all the 'extra priveleges' the old license affords you like towing trailers, trucks up to 5 tonnes, mini buses etc...all these things you have to take extra tests for now.
I've said all I want to say about this coates. Best of luck with whatever you decide.

I've been bloody lucky considering how many miles I've driven.
I've over 20 years NCB, no points ever and used to drive buses. I must have been speeding at some point (or 2 or 3 lol)in all that time, just good luck there wasn't a camera there at the time.

according to the association of chief police officers they say it doesnt warrant prosecution if speeding is under 50mph in a 30 mph zone so my 35mph looks very ok

Its a fixed penalty notice for 35 in a 30, shouldn't be a court appearance at all. It is automatic 3 points though and more expensive insurance ofc.
They should first write to you to confirm you are the owner of the vehicle and was driving on the date and time shown. Its at that point you should contact the local police in the area to offer speed awareness training course seeing as its the minimum speed for automatic points.

Theres no court appearance for 35 though.
