Workers arrested at South Africa's Marikana mine have been charged in court with the murder of 34 of their colleagues shot by police.
The 270 workers would be tried under the "common purpose" doctrine because they were in the crowd which confronted police on 16 August, an official said.
Police opened fire, killing 34 miners and sparking a national outcry.

National Prosecuting Authority (NPA) spokesman Frank Lesenyego told the BBC the 270 workers would all face murder charges - including those who were unarmed or were at the back of the crowd.

The world is as mad as Ogden Nash, only in his case he had a sense of humour....and a very wise head.
This is beyond unbelievable.
Mind you, I'm pretty certain there is something along the same lines on the 'books' in the UK. If a gathering is deemed illegal, then the police cannot be prosecuted here if they have to use 'reasonable force' to disipate a crowd.

No - although it wouldn't surprise me if it was on the cards.

However - they've spent years fuzzying hte line between demonstrators and rioters, and rioters and terrorists, and are (not for the 1st time) trying to push laws through for 'terrorists' to be arrested, tried & charged in secret.

Also, I remember reading years ago, that an amendment to an amendment of the Lisbon Treaty authorises the execution of terrorists.

Excellent! The whole force is responsible for all deaths at the hands of the filth.

Personally I welcome these kind of blatantly ridiculous rulings, it can only bring about the inevitable sooner rather than later

S.Africa to drop murder charges against miners

PRETORIA — South Africa's top public prosecutor said Sunday that controversial murder charges against 270 miners for the killing of fellow workers shot dead by police, will be provisionally dropped.

"The murder charge against the current 270 suspects, which was provisional anyway, will be formally withdrawn provisionally in court on their next court appearance," acting national director of prosecutions Nomgcobo Jibo told a news conference.

Thursday's decision to charge the miners over the August 16 killings during a wildcat strike at the Lonmin platinum mine, in what was the worst police violence since the end of apartheid, had triggered outrage.

The workers have been held in custody since they were arrested on the day of the shooting at Lonmin's mine in Marikana, northwest of Johannesburg.

Does double jeopardy apply over there though, I wonder? Or does that only apply to prosecution as opposed to charges being levelled?

I don't know about SA but here it only applies to prosecution. You can be charged, have the charges dropped and then recharged.
Seems the same in Sweden ;)

It's my understanding that double jeopardy only applies after a trial has taken place.

Shocking autopsy: South African police 'shot fleeing protesters in the back'

South African police are facing accusations of mass murder after autopsies on the victims of a bloody crackdown at Marikana platinum mine, showed that miners were shot in the back. Meanwhile, new violence has broken out at the location.
Police claim they used weapons to defend themselves against a wave of strikers after first trying to quell them with tear gas and water cannons. Thirty-six people were killed during the standoff, only two of them policemen. The protesters, numbering in there thousands, were calling for pay rises.
But post-mortem results of the victims suggest that the strikers posed no danger to the law enforcers at the time of the shooting.
“The post-mortem reports indicate that most of the people were fleeing from the police when they got killed,” a police source told Johannesburg’s Star newspaper. “A lot of them were shot in the back and the bullets exited through their chests. Only a few people were found to be shot from the front.”
Eyewitness reports previously indicated that a small group of protesters charged at the police barricade with machetes and clubs, fired a stolen police gun, and killed two officers before the uniformed men unleashed a deadly 3-minute hail of bullets.
An official spokesman refused to confirm or deny the accusations on what’s already being dubbed the Marikana Massacre – the most violent episode in South Africa’s history since the 1994 fall of apartheid.
But the Independent Police Investigative Directorate (IPID), a police watchdog, is investigating the miners’ deaths as murders.
It also says that miners have launched dozens of complaints accusing the police of brutal treatment when they were arrested in the aftermath of the skirmish.
Released mine workers say they were beaten with batons as officers tried to find out who was responsible for the initial attack on policemen.
