Peter Barker, the man whose 'Bedroom Tax' loophole could help up to 40,000 housing benefit claimants to get their money back

Iain Duncan Smith’s nemesis has never sat on the green benches of parliament. In fact, he has never met the Work and Pensions Secretary at all.

But Peter Barker, a 53-year-old self-confessed anorak from Romford, Essex, made a discovery that is likely to cost the minister millions. He found a loophole in the so-called bedroom tax which could mean that up to 40,000 housing benefit claimants can claim money back.

Overall the controversial policy affects around 660,000 housing benefit claimants who are deemed to have one or more “spare” rooms and have between £14 and £22 a week deducted from their benefits.

Tenants who have occupied the same property continuously and taken housing benefit for it since 1996 should never have been included in the policy, Mr Barker discovered. When the Department for Work and Pensions drafted the controversial legislation it did not update housing benefit regulations dating from that year.

Those affected include some who are facing eviction because of the bedroom tax- or who have been forced to move to smaller properties.

Yeah, there was a woman who committed suicide over it recently iirc, turns out she was one of the 40,000 and she had nothing to fret about...

Does that include people who have been privately renting Abs? Cos I've always been a private tennant and since the girls went to uni I have had to pay the extra way before the bedroom tax.

AFAIK the bedroom tax only affects those in social housing, as the allowances related to private tenants were changed in 2010 when Local Housing Allowance was brought in. Effectively, private tenants have already had a 'bedroom tax' for four years.

Lot longer than that WuB...it's always been there for private tennants...I've been renting for 14 years and only became liable for 'the difference' when my second girl went to Uni 3 years ago.

Private tenants got screwed a long time ago when maggie thatcher introduced the fair rent act AND sold off the council houses, which ofc caused a massive private rental speculation bubble and stupid overpriced housing.

Oh, I've never had to claim it, but I know it was all supposed to change a few years ago when HB became LHA. Anyway, I don't know what you receive, but I'd be surprised if the loophole relates to private tenants as the 'Bedroom Tax' was (officially) supposed to level the playing field between social and private tenants. Obviously that's not the real reason for it, but anyway I would be highly surprised if any private tenants can get more, but I might be wrong.
