Hi everyone.

In order to 'cover our backs' so to speak, we are going to have to implement certain legal terms & conditions that members will need to agree to when registering at sanctumzone. This is to protect all of us in our community here.

If you go to 'Info' on the options at the top (next to Home, Forum, Live Chat, The Zone) then 'terms and policy docs', you will see what has been drafted there for your perusal/approval, (Terms of Service etc)

Please do have a careful read through it all and let us know what you do and don't approve of. Its not written in stone or anything yet, & the final wording of the drafts put in place will be decided by you the community.

Thank you in advance for your time & our apologies if it all looks a bit 'in your face'...we understand that it may do so, but at the end of the day we really do need something like this in place.

Looks good to me, but I don't speak legalese.

What's that bit about images/photos? Does it mean we can't just randomly post images we find online?

Nah...peeps can post any images/photo's/vids etc they find online (excepting pornography/similar 'offensive' material obviously) that they wish to.

At the end of the day its all just 'legal waffle' intended to cover sanctumzone's back. ;)

Most of it's good... don't like the rest.

:) The purpose here is to get rid of the bits we all don't like, by jointly consulting as a community on these initial (and far from perfect) draft/s we've cobbled together.

I have a couple of areas which bleep on my radar guys.

I suppose my concerns are about the potential for misuse, misrepresentation or profiteering without further discussion, consent or approval from the material contributors.

For the avoidance of doubt, I have no basis to believe that anyone representing sanctumzone.co.uk at this time has any nefarious intent, far from it, but this agreement is for perpetuity.
I also speculate that these terms and conditions are a customised freely available template, covering a wide range of web publishing scenarios including; blogs, contributor news feeds and opinion/commentary sites and as such perhaps not specifically reflective of our bulletin board relaxed discussions situation.

I respectfully suggest that the areas of concern I have highlighted below could be addressed by a policy of mutual consent between the originator and sanctumzone.co.uk, on an instance by instance basis.



6.0.1 Submitting text for publication on sanctumzone.co.uk


(i) publication of any material you submit to us will be at our sole discretion. We reserve the right to make additions or deletions to the text or graphics prior to publication, or to refuse publication. We also reserve the right to edit, amend or delete any content after its publication at our sole discretion

(ii) you grant us a non-exclusive, perpetual, royalty-free, worldwide licence to republish any material you submit to us in any format, including without limitation print and electronic format

7.0.1 Submitting text, graphical material and photography for publication on sanctumzone.co.uk

When you send a photograph or other graphical material to us you do so in accordance with these Terms of Service.
This means that you hereby agree that you have taken the photograph(s) you have sent to us or you have permission from or are authorised by the owner of the photograph(s) to send it (them) to us, and you are granting us a non-exclusive, royalty-free licence to publish or otherwise use the photograph(s) in any way and at any time we want on the sanctumzone.co.uk web site/s.

Selected photographs and graphical material will be published at the discretion of the editor and you will not be paid, even if your photograph(s) is (are) published.

We may cut, edit, crop or arrange your photograph(s) or graphic as we see fit to appear on the sanctumzone.co.uk web site, and we may remove your photograph(s) or graphics at any time.

(viii) we will assist any government or law enforcement agency where we are obliged to under the law. This maybe without requesting your consent when it is requested that we do so. We will also report any illegal content or activity to the relevant agencies or governments.

Which to be fair, is probably abit you's don't have any say over... but maybe not?

Hi, i would just like to add that this site has the ability to be all of those things i quoted you above, and these options can be added in the future...including articles submitted by members and so on.

So yes the terms have been created to cover a wider range of scenarios than just the bulletin board portion of this site, namely the terms must cover use of the entire site.

Just to clarify once more, this site is more than just a forum/bulletin board and we may bring some of those features online in the future.

Ok again the first portion of this refers to submitted articles, which i think is reasonable, should we provide that feature in the future. Since forum posts are published without review, the first sentence can not and does not apply to forum posts.

The second sentence can refer to both submitted articles and bulletin board posts, and i think its reasonable that the management can edit posts and articles, such as circumstances where they are seen to be offensive after publication.

I've mentioned this to DG... just how many of us actually ever read these things properly before we click that 'accept' option?

I know I don't. Could be signing myself away to all sorts when I think about it.


It might be easier if you's could show us the parts that where drafted up by yourselves and the parts that you have no control over, seperately? Just a thought :)

Well we dont have much say psketti, if anything ever came to that, and the authorities wanted us to comply with instructions they give, its obvious that we must comply with the law or face prosecution ourselves, so i think the above is reasonable.

If people are going to use this site for illegal activity then the site management team should not be held responsible for, or have to cover for, members partaking in such activities. Reasonable enough?

Well they are both pretty much one and the same psketti. These terms are basically to cover management from liability...all of them.

As no one is doing this for financial gain, we havent added any parts for any self benefit.

Of course the management/owners of a site have a right to stipulate their conditions of use/participation.
My reservations on the areas I highlighted were to do with the principles of editing, amending or republishing content without consultation or agreement with the originator. (potential public offence aside as that is clearly a moderation issue where content should be removed in its entirety if the submitter was unwilling to redraft it or unavailable to do so promptly).

I'm genuinely not being awkward or accusatory in my comments. Feedback was requested. Which again is something novel and I take my hat off to you guys for.
